The terms that govern your use of 4x4rockcats.com and any purchases made through it.
These Terms include a mandatory 60-day informal dispute-resolution step, a binding arbitration agreement, and a class-action waiver that affect how disputes between you and 4x4 Rockcats are resolved. You may opt out of the arbitration agreement within 30 days of first accepting these Terms — see the dispute-resolution section below.
A binding order is formed only when you submit it through checkout and we send an order confirmation. We may decline any order before acceptance. Prices are in U.S. dollars and exclude taxes, shipping, and handling, calculated at checkout; for accepted orders, the price at the time of acceptance governs. If a typographical, system, or pricing error affects your order, we may cancel it and issue a full refund before shipment.
Consumer payment is due at checkout and is processed through Stripe (or any successor processor). We ship only to the contiguous United States (CONUS); estimated delivery dates are not guaranteed.
Except for the express warranties in our 3-Year Limited Warranty and RMA Policy, and except for any warranty that cannot be disclaimed under applicable law, the Site and all products, services, and content are provided “AS IS” and “AS AVAILABLE,” without warranty of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
Off-road use warning. Our products are designed for use on off-road vehicles. Off-road driving is inherently dangerous and can result in property damage, serious injury, or death. You are responsible for selecting parts appropriate for your vehicle and intended use, having installation performed by a qualified professional where appropriate, inspecting installations regularly, and operating your vehicle safely and within the limits of your equipment and skill.
To the fullest extent permitted by law, 4x4 Rockcats is not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or relating to these Terms, the Site, or any product or service. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us for the product or service giving rise to the claim in the preceding twelve months, or one hundred U.S. dollars ($100).
This cap does not apply to liability for death or bodily injury caused by our gross negligence, recklessness, or willful misconduct; to liability that cannot be limited under applicable law; to your indemnification obligations; or to amounts you owe us for products or services.
Informal resolution first (60 days). Before either party may start arbitration, the party raising a dispute must send written notice to legal@4x4rockcats.com describing the dispute and the relief sought, and the parties will negotiate in good faith for sixty (60) days. Neither party may file an arbitration until that period has expired.
Binding individual arbitration. If the dispute is not resolved, it will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, seated in Camden County, New Jersey, rather than in court — except for small-claims actions and certain intellectual-property or equitable-relief matters.
Class-action waiver. Disputes must be brought in an individual capacity only, not as a plaintiff or class member in any class, collective, or representative proceeding.
30-day opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@4x4rockcats.com with the subject line “Arbitration Opt-Out” and your name, address, email, and an account or order number. If you opt out, the rest of these Terms still apply.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. For any matter not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Camden County, New Jersey. To the fullest extent permitted by law, each party waives the right to a trial by jury for any matter heard in court.
These Terms incorporate, by reference, our Privacy Policy, Cookie Policy, Limited Warranty Policy, Return & Exchange Policy, and Shipping Policy. By using the Site, you agree to those policies as well.
